How do I choose and register a business name in Australia?
Pick a name, check it is not already registered on ASIC's business names register, not identical to an existing company name and not a registered trade mark, then register it with ASIC if you trade under a name other than your own. A business name is not the same as a trade mark, and registering one does not give you the exclusive right to use it.
The checks to run
1. Search ASIC's business names register for the same or similar names. 2. Search ABN Lookup, which shows names tied to ABNs. 3. Search IP Australia's trade mark database; a registered mark in your class can stop you using the name. 4. Check the domain name and social handles.
If you trade under a name other than your own legal name, you must register the business name with ASIC. A company name is separate and is registered when the company is.
Business name, company name and trade mark
A business name lets you trade under a name, and does not give exclusive rights. A company name is registered with ASIC when you set up a company. A trade mark protects a brand name or logo against use by others, and is registered with IP Australia.
Once you have a name, use the ABN validator to check your number and the invoice generator to bill.
How this is calculated
The rule, step by step, so you can check any figure by hand.
each idea combines your keyword with a word from the list for your industry and styleideas are shuffled; press the button for a new setthis tool cannot confirm availability: check ASIC, IP Australia and the domain yourself
Generated names are starting points, not checked ones. Availability depends on registers this page cannot reach: ASIC's business names register, the company name search, IP Australia's trade mark database and the domain registry.
Short, easy-to-spell names that say what you do tend to work best, and a name that is too close to an existing brand can leave you open to a trade mark claim even if ASIC lets you register it.

Choosing well
A good name is short, easy to say and spell, free of awkward meanings and not too narrow, so you can grow into other services. Say it out loud on the phone, check how it looks in a logo and ask a few customers what they think.
What it leaves out
The generator does not check availability, spelling variants in other languages or negative meanings. Always do your own checks before printing signage.
What this calculator does not do
- Generated names are not checked for availability
- Does not search ASIC, IP Australia or domains
- Word lists are English only
- A name does not give exclusive rights
Common questions
How do I register a business name in Australia?
Through ASIC, once you have checked the name is available. The registration lasts one or three years and can be renewed.
Is a business name the same as a trade mark?
No. A business name lets you trade under it; a trade mark protects it from use by others.
Does an ABN give me the right to use a name?
No. An ABN identifies your business; you still need to register a business name if you trade under one.
How do I check whether a name is taken?
Search the ASIC business names register, ABN Lookup, IP Australia's trade mark search and the domain registry.
Can I use my own name without registering it?
Generally yes, if you trade under your own full name, though registering a trade mark may still be wise.
